Common Questions About Estate Litigation Costs

How are Estate Litigation fees calculated?

Estate litigation fees at Direct Lawyers are charged on an hourly basis, in six-minute increments. Rates range from $150 to $450 per hour depending on the complexity of the task and the experience of the team member attending to it. A detailed cost estimate is provided after your initial consultation.

Do I have to pay costs if I lose?

In Queensland, courts have broad discretion over costs orders in Estate Litigation matters. While costs do not automatically follow the outcome, there is a real risk of an adverse costs order if a claim is unsuccessful or poorly prepared. We discuss the costs risks of your specific matter clearly at the outset.

Can Estate Litigation costs be recovered from the estate?

In some circumstances, a party’s legal costs may be paid from the estate — particularly where the litigation was reasonably necessary to resolve a genuine dispute. Whether this applies depends on the outcome and the court’s discretion. We advise on this as part of your overall litigation strategy.

How long does Estate Litigation take?

Timeframes vary significantly. Matters that resolve through early negotiation may conclude within a few months. Matters that proceed to a final hearing before the Supreme Court of Queensland can take one to two years or longer. Time limits also apply — family provision claims must generally be filed within nine months of the date of death.

What is the difference between professional fees and outlays?

Professional fees are the charges for legal work performed by our team — research, advice, drafting, and court appearances. Outlays are third-party costs incurred on your behalf, such as court filing fees, expert reports, and barrister fees. Both are itemised clearly in your cost disclosures.

Is a discovery call free for Estate Litigation matters?

Yes. The free 10-minute discovery call is the right first step if you are unsure whether we can help. We will listen, explain what your options may be, and confirm whether we can assist. There is no obligation and no cost.
